Can Family Members in Austin, Texas Use Sick Leave? - An Expert's Guide

The University of Texas does not have a specific maternity leave policy. However, employees who are unable to work due to pregnancy-related issues can use their sick time to cover the disability. This includes prenatal visits, complications during pregnancy, and recovery after childbirth. The amount of time off depends on the type of delivery, with six weeks for a vaginal delivery and eight weeks for a C-section.

Employees are entitled to sick leave if they have worked at least 80 hours in a calendar year for an employer covered by insurance. They can request an FMLA package at any time, and their department can ask the Leave Administration to send them one. The amount of sick leave they have accumulated and used must be documented by the employer. The future of San Antonio's law is likely to depend on the outcome of Austin's court decision on sick leave.

The new law requires employers to record time spent with exempt employees for the purpose of accumulating sick leave. If an employer already has a policy that grants employees paid time off in accordance with the new requirements, there is no need to grant additional paid leave. Employers are also prohibited from retaliating against an employee who uses sick leave or attempts to assert their rights under the law. If the Austin Sick Leave Ordinance goes into effect, business owners will have to comply with their obligations simultaneously.

Employees must be able to start using accumulated paid sick leave no later than 60 calendar days after they start their employment. They can also donate sick time to another individual, and if they are the intended recipient of donated sick time, Leave Management will notify them. At least once a month, employers must provide each employee with a statement showing the amount of accumulated sick leave available to them. They can only prohibit new employees from using sick leave if their minimum period of employment is one year or more.

If an employee accumulates a large amount of sick leave over several years, they may be restricted from using all of it in one year.
